I. ACCEPTANCE OF SERVICE

WhatYah provides its service to you, subject to these Terms of Service [TOS], which may be updated periodically without prior notice. The TOS will always be available from this location. Failure to comply with these TOS may result in account removal.

II. DESCRIPTION OF SERVICE

WhatYah is an online (web-based) service that allows its users to catalogue their collection of multimedia and to browse through the collections of other members, none of the content listed on member accounts is at any time hosted or stored on WhatYah servers.

III. YOUR REGISTRATION OBLIGATIONS

Account registration and verification is required in order to create a WhatYah account. In order to verify your account a valid email address is required. Accounts are also verified using the Completely Automated Public Turing Test to Tell Computers and Humans Apart [CAPTCHA] system. Valid information should also be entered into all other required fields for registration. Should you feel that WhatYah’s privacy policy is not sufficient for you to complete the registration form truthfully, please email your policy concerns to privacy@whatyah.com The content that you list onto your account should be owned by you, (where by owned meaning you have made a purchase from an authorised retailer of the multimedia product which you are listing.) Members found to be attempting to make profit from their accounts by attempting to sell/rent multimedia will be subject to account termination.

IV. WHATYAH PRIVACY POLICY

Your account information is subject to the WhatYah privacy policy which can be viewed here http://www.whatyah.com/privacy.

V. GENERAL PRACTICES REGARDING USE AND STORAGE

WhatYah may occasionally send you emails in regards to updates of the service, or information about your account; however, we will never ask you to submit additional personal information or to verify the status of information related to your account in any such email.

VI. INDEMNITY

You herein agree to indemnify WhatYah.com, and those associated with the site from ANY AND ALL damages made by a third party from your content on the site and/or your use of the service.

VII. NO RESALE OF SERVICE

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service.

VIII. ACCOUNT TERMINATION

You agree & understand that WhatYah reserves the right to at any time terminate your account & all information stored on WhatYah servers for any reason, including and without limitation, the lack of use or if WhatYah believes that you have violated the TOS.

IX. ADVERTISEMENTS AND PROMOTIONS

Some or all of the site may include advertisements. You understand and agree that you will not obscure any advertisements from general view via HTML/CSS or any other means. By using the site, you agree that WhatYah has the right to run such advertisements with or without prior notice. The manner, mode and extent of advertising by WhatYah on your Content and throughout the site are subject to change at WhatYah’s discretion. Your business dealings with, or participation in promotions of, advertisers found on or through the site, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. WhatYah has no responsibility between you and any Third Party whom you choose to deal with after finding them on the site.

X. DISCLAIMER OF WARRANTIES

YOU MUST COMPREHEND AND CONCUR THAT: (a) YOUR USE OF THE SITE IS AT YOUR SOLE RISK. THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. (b) WHATYAH MAKES NO WARRANTY THAT (i) THE SITE WILL MEET YOUR REQUIREMENTS, (ii) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE WILL BE ACCURATE OR RELIABLE, (iv) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED. (c) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SITE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA OR OTHER LIABILITYTHAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL. (d) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM CONTACT WITH WHATYAH.COM OR THROUGH/FROM THE SITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.

XI. VIOLATIONS

You should report suspected violations of the TOS immediately to abuse@whatyah.com

XII. REVISIONS

WhatYah may at any time amend these Terms of Service by updating this posting. By using this Site, you agree to be bound by any such revisions and should therefore periodically visit this page to decide on the then-current Terms of Service to which you are bound.
